1. Acceptance of Terms

By accessing or using QuestionCraft™ ("Service," "Platform," "we," "us," or "our"), operated by QuestionCraft LLC, a Massachusetts limited liability company, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms," "Agreement"). If you do not agree to these Terms, you may not access or use the Service.

By creating an account, you represent that:

  • You are at least 18 years old or have parental/guardian consent
  • You have the legal capacity to enter into a binding agreement
  • You will comply with all applicable laws and regulations
  • All registration information you provide is accurate and current

2. Description of Service

QuestionCraft is an AI-powered platform that helps users optimize questions before submitting them to AI language models. Our Service includes:

  • Question Engine: Interactive AI coaching to improve question quality
  • Multi-AI Comparison: Side-by-side responses from multiple AI models
  • Framework Library: Specialized question templates for various use cases
  • Analytics Dashboard: Insights into question improvement and AI performance
  • API Access: Programmatic access to optimization features (Master tier and above)
  • Community Resources: 30,000+ curated question bank and 20 community pages

QuestionCraft is a gateway tool that enhances your use of third-party AI services (OpenAI, Anthropic, Google, etc.). We do not own or operate these underlying AI models; we facilitate access to them through official APIs.

3. Account Registration and Security

3.1 Account Creation

  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to notify us immediately of any unauthorized access or security breach
  • You are solely responsible for all activities that occur under your account

3.2 Account Eligibility

  • One account per user (no sharing accounts across multiple individuals)
  • Corporate/team accounts require appropriate Enterprise tier subscription
  • We reserve the right to refuse service or terminate accounts at our sole discretion

3.3 Account Termination

  • You may cancel your account at any time through account settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your access to the Service will cease immediately
  • We will retain some data as required by law or for legitimate business purposes

4. Subscription Plans and Billing

4.1 Subscription Tiers

QuestionCraft offers multiple subscription tiers. All paid tiers include up to 5,000,000 tokens per month for AI operations:

  • Tinkerer (Free): Limited features for trial users - 5M tokens/month
  • Crafter ($15/month or $144/year): Enhanced features for regular users - 5M tokens/month
  • Master ($39/month or $374/year): Advanced features including API access (beta) - 5M tokens/month
  • Architect ($69/month or $662/year): Premium features with highest limits - 5M tokens/month
  • Enterprise (Custom): Tailored solutions for teams and organizations - Custom token limits

Token Usage: All AI operations (question optimization, assessments, auto-optimize, AI comparisons) count toward your monthly token limit. Limits reset on the 1st of each month.

4.2 Billing and Payment

  • Subscription fees are charged in advance on a monthly or annual basis
  • Payment is processed through our third-party payment processor (Stripe)
  • You authorize us to charge your payment method for all applicable fees
  • All fees are in U.S. Dollars and are non-refundable except as specified in Section 4.5
  • We reserve the right to change pricing with 30 days' notice to existing subscribers

4.3 Automatic Renewal

  • Subscriptions automatically renew at the end of each billing period
  • You will be charged the then-current rate unless you cancel before renewal
  • You may cancel automatic renewal through your account settings
  • Cancellation takes effect at the end of your current billing period

4.4 Free Trial

  • New users may receive a 7-day free trial on paid plans
  • Credit card required for trial activation
  • You will be charged automatically after trial ends unless you cancel
  • We reserve the right to modify or discontinue free trials

4.5 Refund Policy

  • 7-day trial: Cancel anytime during trial for full refund
  • Monthly subscriptions: No refunds for partial months after trial period
  • Annual subscriptions: Refund available within 30 days of purchase, prorated based on usage
  • Refund requests: Contact support@questioncraft.ai with your account details
  • Exceptions: Refunds may be granted at our sole discretion for extenuating circumstances

4.6 Taxes

  • Subscription fees do not include applicable taxes
  • You are responsible for all sales, use, and excise taxes
  • We will collect taxes as required by law

5. Fair Use Policy

5.1 "Unlimited" Features and Token Limits

Features labeled as "Unlimited" are subject to fair use guidelines and monthly token limits designed for reasonable professional individual use:

  • Token Limit (All Tiers): All users are subject to a 5,000,000 token monthly limit (~150-300 high-quality AI comparisons daily for typical professional use)
  • "Unlimited" Defined: When we say "unlimited," we mean up to 5 million tokens per month per user account
  • What Counts as Tokens: All AI operations including question optimizations, assessments, auto-optimize, and AI comparisons
  • Reset Schedule: Token usage resets automatically on the 1st of each calendar month
  • Question Optimizations (Master/Architect): Designed for personal or small team use, not automated bulk processing
  • Typical usage patterns: 50-200 AI operations per day for active professional users

Fair use guidelines apply to prevent abuse while allowing generous professional use.

5.2 Fair Use Definition

Fair use means:

  • Human-driven workflows: Not fully automated bot behavior or scripts designed to circumvent limits
  • Individual use: Personal or small team usage, not serving hundreds of end users through your application
  • Professional purposes: Research, business tasks, learning, productivity - not commercial reselling

5.3 Prohibited Usage Patterns

The following are NOT fair use and may result in account suspension:

  • Running automated scripts to generate thousands of comparisons per day
  • Using QuestionCraft as infrastructure to serve your customers (requires Enterprise tier)
  • Creating multiple accounts to circumvent usage limits
  • Systematic extraction of AI responses for resale or redistribution
  • Bot traffic, spam, or abuse that degrades service for other users

5.4 Enforcement

If usage significantly exceeds fair use guidelines, we may:

  1. Contact you to understand your use case and suggest optimizations
  2. Recommend upgrading to Enterprise tier for high-volume usage
  3. Temporarily throttle excessive usage to ensure service quality
  4. Suspend or terminate accounts engaged in abuse

We will always attempt to communicate before taking action except in cases of obvious abuse, fraud, or illegal activity.

6. API Access and Usage

6.1 API Eligibility

  • API access is available to Master, Architect, and Enterprise tier subscribers
  • You must maintain an active paid subscription to use the API
  • API keys are non-transferable and must be kept secure
  • You are responsible for all activity using your API keys

6.2 Permitted API Uses

You may use the QuestionCraft API to:

  • Integrate question optimization into your own applications for your use
  • Automate processing of your own questions through scripts or tools
  • Access your question history, analytics, and comparison results programmatically
  • Build internal tools and workflows for your organization
  • Create custom dashboards and reporting for your team

6.3 Prohibited API Uses

You may NOT use the QuestionCraft API to:

  • Resell or redistribute API access to third parties
  • Build competing services that replicate QuestionCraft's core functionality
  • Scrape or systematically harvest AI responses for purposes other than your own use
  • Train AI models (yours or third parties') using outputs from QuestionCraft
  • Circumvent usage limits through multiple accounts, API key sharing, or other means
  • Spam, abuse, or illegal activities of any kind
  • Share API keys with unauthorized users or embed them in public applications
  • Reverse engineer or attempt to extract our proprietary algorithms or methods

6.4 API Rate Limits

  • Master Tier: 100 API calls per hour
  • Architect Tier: 500 API calls per hour
  • Enterprise Tier: Custom limits negotiated separately

We reserve the right to throttle or block requests that exceed rate limits or exhibit abusive patterns.

6.5 API Availability

  • We do not guarantee 100% uptime or availability of the API
  • We may perform maintenance that temporarily affects API access
  • We will provide reasonable notice for planned maintenance when possible
  • We are not liable for API downtime or service interruptions

6.6 API Changes

  • We reserve the right to modify, deprecate, or discontinue API endpoints
  • We will provide reasonable notice (typically 90 days) for breaking changes
  • Non-breaking changes may be deployed without notice
  • We maintain API versioning to support backward compatibility when feasible

7. AI-Generated Content and Third-Party Services

7.1 Third-Party AI Providers

QuestionCraft uses APIs from multiple third-party AI providers, including but not limited to:

  • OpenAI (ChatGPT models)
  • Anthropic (Claude models)
  • Google (Gemini models)
  • Perplexity, xAI (Grok), Mistral AI, DeepSeek, Meta (Llama)

By using our Service, you agree to comply with the terms of service of these providers.

7.2 AI Provider Changes

  • We may add, remove, or change AI providers at our discretion with reasonable notice
  • Subscription tier benefits (number of models) remain consistent even if specific providers change
  • We are not liable for changes to third-party AI providers' terms, pricing, or availability
  • Provider outages or API issues may temporarily affect QuestionCraft functionality

7.3 Your Rights to AI-Generated Content

  • You own the outputs generated from questions YOU submit through QuestionCraft
  • You may use AI-generated outputs in your work, content, and applications
  • You may share individual results as needed for your legitimate purposes
  • You retain intellectual property rights to your original questions and inputs

7.4 Restrictions on AI Content

You may NOT:

  • Use AI-generated outputs to train competing AI models (violates provider terms)
  • Systematically scrape and redistribute AI responses at scale
  • Represent QuestionCraft's aggregated AI comparison results as your own proprietary data
  • Use outputs for illegal purposes or in violation of third-party AI provider terms
  • Bulk redistribution of AI responses requires written permission or Enterprise agreement

7.5 No Warranties on AI Outputs

  • AI-generated content may contain errors, inaccuracies, or biases
  • We do not verify, endorse, or guarantee the accuracy of AI responses
  • You are solely responsible for evaluating and using AI outputs appropriately
  • Do not rely on AI outputs for critical decisions without independent verification

7.6 Attribution (Optional)

When sharing QuestionCraft results publicly, we appreciate (but do not require) attribution such as:

  • "Question optimized with QuestionCraft"
  • "AI comparison via QuestionCraft.ai"

8. Intellectual Property Rights

8.1 QuestionCraft Ownership

We own all rights, title, and interest in:

  • The QuestionCraft platform, software, and technology
  • Our proprietary question optimization algorithms and methods
  • All branding, logos, trademarks, and visual designs
  • The Framework Library, community pages, and curated question bank
  • Analytics systems, comparison infrastructure, and technical architecture

8.2 Your Content

  • You retain ownership of questions, inputs, and original content you submit
  • You grant us a limited license to use your content to provide the Service
  • This license includes rights to process, store, and display your content as necessary
  • We may use anonymized, aggregated data derived from user activity to improve the Service

8.3 Feedback and Suggestions

  • If you provide feedback, suggestions, or ideas about QuestionCraft, we may use them freely
  • You grant us a perpetual, worldwide, royalty-free license to implement feedback
  • We have no obligation to implement suggestions or compensate you for ideas

8.4 Restrictions on Your Use

You may NOT:

  • Copy, modify, or create derivative works of QuestionCraft's proprietary technology
  • Reverse engineer, decompile, or attempt to extract source code
  • Remove or alter any proprietary notices or labels
  • Use our branding or trademarks without written permission
  • Frame or mirror any part of the Service without authorization

8.5 Trademark Notice

QuestionCraft™ is a trademark of QuestionCraft LLC, USPTO Application No. 99530078. All QuestionCraft™ marks, logos, and service marks displayed on the Service are trademarks of QuestionCraft LLC. You may not use, copy, or display these marks without our prior written consent.

9. User Conduct and Prohibited Activities

9.1 Acceptable Use

You agree to use QuestionCraft only for lawful purposes and in accordance with these Terms. You are responsible for all activity under your account.

9.2 Prohibited Activities

You may NOT:

Security and Abuse:

  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Introduce viruses, malware, or malicious code
  • Conduct security testing or penetration testing without written permission
  • Use the Service to attack, harm, or interfere with other systems
  • Overload or disrupt our infrastructure through excessive requests

Fraud and Illegal Activity:

  • Provide false or misleading information during registration
  • Use stolen or fraudulent payment methods
  • Engage in phishing, scamming, or deceptive practices
  • Use the Service for any illegal purpose or in violation of any laws
  • Facilitate money laundering, terrorism financing, or other criminal activity

Commercial Abuse:

  • Resell or redistribute QuestionCraft access without Enterprise agreement
  • Build competing products using our technology or methods
  • Scrape, harvest, or systematically extract data at scale
  • Circumvent paywalls or subscription restrictions
  • Create multiple accounts to evade limits or avoid payment

Content and Conduct:

  • Submit content that violates others' intellectual property rights
  • Use the Service to generate spam, harassment, or harmful content
  • Impersonate others or misrepresent your affiliation
  • Violate third-party AI providers' acceptable use policies
  • Use outputs to train AI models without proper authorization

Children's Safety:

  • Use the Service to sexualize, groom, or harm minors in any way
  • Generate content depicting child sexual abuse material (CSAM)
  • Violate any laws related to the protection of children

9.3 Enforcement

Violations may result in:

  • Warning and request to cease prohibited activity
  • Temporary suspension of account or API access
  • Permanent termination of account without refund
  • Legal action and cooperation with law enforcement
  • Liability for damages caused by violations

10. Data Privacy and Security

10.1 Data Collection

We collect and process data as described in our Privacy Policy, including:

  • Account information (email, name, billing details)
  • Questions you submit and optimized versions generated
  • AI comparison results and responses
  • Usage statistics, analytics, and platform interactions
  • Technical data (IP address, browser, device information)

10.2 How We Use Your Data

We use your data to:

  • Provide and improve QuestionCraft services
  • Process payments and manage subscriptions
  • Generate usage analytics and insights for your benefit
  • Create anonymized, aggregated data for service improvement and research
  • Comply with legal obligations and enforce our Terms
  • Communicate with you about your account and the Service

10.3 What We Do NOT Do

We do NOT:

  • Sell your personal data to third parties for marketing purposes
  • Use your questions to train AI models without explicit opt-in
  • Share your individual data publicly or with competitors
  • Access your account without authorization except as required by law
  • Train our own proprietary AI models on your content without consent

10.4 Data Sharing with AI Providers

When you use QuestionCraft:

  • Your questions are sent to third-party AI providers via their official APIs
  • These providers process requests according to their own privacy policies
  • We use API access (not browser sessions), so they see our API keys, not your identity
  • We do not share your QuestionCraft account information with AI providers
  • AI providers may retain data according to their policies (typically 30 days for API usage)

10.5 Data Retention

  • Active accounts: We retain your data while your account is active
  • Deleted accounts: We delete personal data within 30 days (except as required by law)
  • Backups: Backup systems may retain data for up to 90 days for disaster recovery
  • Aggregated data: Anonymized, non-identifiable data may be retained indefinitely
  • Legal holds: We retain data longer when required by law or legal process

10.6 Data Security

We implement reasonable security measures to protect your data, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Regular security audits and vulnerability assessments
  • Access controls limiting employee access to user data
  • Secure authentication and password requirements

However, no system is 100% secure. You acknowledge that you provide information at your own risk.

10.7 Data Breach Notification

In the event of a data breach affecting your personal information, we will:

  • Notify you within 72 hours of discovering the breach
  • Describe the nature of the breach and data affected
  • Outline steps we are taking to address the breach
  • Advise on steps you can take to protect yourself

10.8 Your Rights

Depending on your jurisdiction (e.g., GDPR, CCPA), you may have rights to:

  • Access your personal data
  • Correct inaccurate data
  • Delete your data (right to be forgotten)
  • Restrict or object to processing
  • Data portability (export your data)
  • Opt-out of certain data uses

11. Commercial and Enterprise Use

11.1 When You Need Enterprise Tier

Individual and team plans (Tinkerer/Crafter/Master/Architect) are designed for personal or small team use. Contact us for Enterprise pricing if you:

  • Are serving QuestionCraft functionality to 50+ end users through your application
  • Need API rate limits significantly above 500 calls/hour
  • Require white-label, embedded solutions, or custom branding
  • Are building a product or service that depends on QuestionCraft as core infrastructure
  • Need custom integrations, dedicated support, or SLA guarantees
  • Have usage patterns significantly exceeding fair use guidelines

11.2 Reselling Prohibition

Individual and team plans do NOT include rights to:

  • Resell QuestionCraft access or functionality to your customers
  • Embed QuestionCraft in a paid product or service without Enterprise agreement
  • Provide QuestionCraft features as a service to third parties for commercial gain
  • Use QuestionCraft as backend infrastructure for a competing product

Violation of this prohibition may result in immediate account termination and legal action.

11.3 Partnership Opportunities

We welcome partnerships and integrations! Contact partnerships@questioncraft.ai to discuss:

  • Affiliate arrangements and revenue sharing
  • Reseller agreements with revenue sharing
  • White-label solutions for your brand
  • Strategic integrations and co-marketing opportunities
  • Custom Enterprise deployments

12. Limitation of Liability

12.1 Service Provided "AS IS"

QUESTIONCRAFT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Non-infringement of intellectual property rights
  • Accuracy, reliability, or completeness of AI-generated content
  • Uninterrupted or error-free operation
  • Security or absence of harmful components

12.2 No Liability for AI Outputs

WE ARE NOT LIABLE FOR:

  • Accuracy, quality, or suitability of AI-generated responses
  • Decisions made based on AI outputs or recommendations
  • Errors, omissions, biases, or harmful content in AI responses
  • Third-party AI providers' performance, availability, or changes to their services
  • Consequences of relying on AI outputs for critical decisions

12.3 No Liability for Service Interruptions

WE ARE NOT LIABLE FOR:

  • Service interruptions, downtime, or maintenance
  • Data loss (though we make reasonable backup efforts)
  • Third-party service failures (AI providers, payment processors, hosting)
  • Force majeure events beyond our reasonable control
  • Your inability to access the Service due to technical issues

12.4 Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO QUESTIONCRAFT IN THE 12 MONTHS PRECEDING THE CLAIM.

For free tier users, our maximum liability shall not exceed $100 USD.

12.5 Consequential Damages Waiver

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Lost profits, revenue, or business opportunities
  • Loss of data or inability to use the Service
  • Reputational harm or goodwill damage
  • Costs of substitute services or procurement
  • Personal injury or emotional distress

THIS WAIVER APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12.6 Exceptions to Limitations

Some jurisdictions do not allow limitation of implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct
  • Any other liability that cannot be excluded by law

13. Indemnification

13.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless QuestionCraft, its officers, directors, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms or any applicable laws
  • Your violation of third-party rights (intellectual property, privacy, etc.)
  • Content you submit or activities conducted through your account
  • Your breach of third-party AI providers' terms of service
  • Fraudulent, illegal, or unauthorized activity under your account
  • Claims by third parties harmed by your use of QuestionCraft

13.2 Defense of Claims

  • We will notify you of any claim subject to indemnification
  • You will cooperate with us in defending the claim
  • We reserve the right to assume exclusive defense and control of any matter
  • You will not settle any claim without our prior written consent

14. Dispute Resolution and Arbitration

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.

14.2 Informal Dispute Resolution

Before filing a claim, you agree to contact us at legal@questioncraft.ai and attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.

14.3 Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Arbitration Terms:

  • Arbitration will be conducted in Massachusetts or remotely via video conference
  • Arbitrator's decision is final and binding
  • Each party bears its own costs unless the arbitrator awards costs to the prevailing party
  • Class actions and jury trials are waived (see Section 14.5)

14.4 Exceptions to Arbitration

The following may be brought in court without arbitration:

  • Small claims court actions (claims under $10,000)
  • Injunctive relief to protect intellectual property
  • Claims of fraud, cybercrime, or illegal activity
  • Enforcement of arbitration awards

14.5 Class Action Waiver

YOU AGREE THAT DISPUTES MUST BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action against QuestionCraft.

14.6 Jurisdiction and Venue

If arbitration does not apply, you agree that any legal action shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in these courts.

15. Termination

15.1 Your Right to Cancel

  • You may cancel your subscription at any time through account settings
  • Cancellation takes effect at the end of your current billing period
  • You retain access until the end of your paid period
  • No refunds for partial months except as stated in Section 4.5

15.2 Our Right to Terminate

We may suspend or terminate your account immediately if you:

  • Violate these Terms or any applicable laws
  • Engage in abusive, fraudulent, or illegal activity
  • Fail to pay subscription fees
  • Use the Service in ways that harm other users or QuestionCraft
  • Pose a security risk or legal liability

15.3 Effect of Termination

Upon termination:

  • Your access to the Service ceases immediately
  • Your right to use the API is revoked
  • We may delete your data in accordance with our retention policies
  • Provisions that by nature should survive termination remain in effect (Sections 8, 9, 12, 13, 14)
  • Outstanding payment obligations remain due

15.4 Data Export Before Termination

We encourage you to export your data before terminating your account:

  • Use the export feature in account settings
  • Download your question history and analytics
  • Save any AI comparison results you need
  • Request data export assistance by contacting support@questioncraft.ai

16. Changes to Terms

16.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be necessary due to:

  • Legal or regulatory requirements
  • Changes to third-party AI provider terms
  • New features or changes to the Service
  • Security, fraud prevention, or abuse mitigation

16.2 Notice of Changes

  • We will provide at least 30 days' notice of material changes
  • Notice will be sent to your registered email address
  • Notice may also be posted on the QuestionCraft website or in your account dashboard
  • Material changes will be highlighted and may require explicit acceptance

16.3 Acceptance of Changes

  • Continued use of the Service after changes take effect constitutes acceptance
  • If you do not agree with changes, you must cancel your subscription
  • You may export your data and close your account if you disagree with changes
  • No refunds will be provided for early termination due to Terms changes (except as required by law)

16.4 Version History

  • Current and previous versions of Terms will be available at questioncraft.ai/terms
  • The "Last Updated" date at the top reflects the most recent changes

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and QuestionCraft regarding the Service and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17.3 No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or any rights hereunder without restriction, including in connection with a merger, acquisition, or sale of assets.

17.5 Force Majeure

17.7 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to U.S. embargo and are not on any U.S. list of prohibited or restricted parties.

17.8 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated. Third-party AI providers are intended beneficiaries of provisions protecting them from liability and misuse.
