Introduction
This Acceptable Use Policy ("AUP") governs your use of QuestionCraft™ ("Service," "Platform," "we," "us," or "our"). This AUP is part of and incorporated into our Terms of Service.
By using QuestionCraft™, you agree to comply with this Acceptable Use Policy.
Violation of this AUP may result in suspension or termination of your account without refund, and may expose you to legal liability.
1. General Principles
1.1 Lawful Use Only
You agree to use QuestionCraft only for lawful purposes and in compliance with:
- All applicable local, state, national, and international laws and regulations
- All applicable export control and sanctions laws
- Terms of service of third-party AI providers (OpenAI, Anthropic, Google, etc.)
- Intellectual property rights of others
1.2 Professional and Ethical Use
You agree to use QuestionCraft in a manner that:
- Respects the rights and dignity of others
- Does not harm or exploit vulnerable populations
- Maintains the integrity and security of the Service
- Aligns with generally accepted professional and ethical standards
1.3 Good Faith Engagement
You agree to:
- Use the Service as intended for legitimate question improvement and AI comparison
- Not attempt to abuse, game, or exploit the platform
- Report security vulnerabilities or bugs responsibly
- Cooperate with our efforts to maintain service quality and security
2. Prohibited Activities
2.1 Security and Technical Abuse
You may NOT:
- Attempt to gain unauthorized access to QuestionCraft systems, other users' accounts, or data
- Introduce or propagate viruses, malware, worms, trojans, or other malicious code
- Conduct security testing, penetration testing, or vulnerability scanning without written permission
- Use automated tools (bots, scripts, scrapers) to access or interact with the Service at scale
- Overload, disrupt, or impair our infrastructure through excessive requests or DDoS attacks
- Circumvent rate limits, authentication mechanisms, or security controls
- Attempt to reverse engineer, decompile, or extract our proprietary algorithms or source code
- Probe, scan, or test the vulnerability of any system or network
- Interfere with or disrupt the Service or servers/networks connected to the Service
2.2 Fraud and Illegal Activity
You may NOT:
- Provide false, misleading, or deceptive information during registration or use
- Use stolen, fraudulent, or unauthorized payment methods
- Engage in phishing, scamming, or other deceptive practices
- Use the Service for any illegal purpose or in violation of any laws
- Facilitate money laundering, terrorist financing, or other financial crimes
- Engage in or facilitate fraud, identity theft, or other criminal activity
- Use the Service to violate export control or sanctions laws
- Create multiple accounts to evade limits, avoid payment, or engage in fraud
- Share account credentials or resell access without proper authorization
2.3 Commercial Abuse and Unauthorized Reselling
You may NOT:
- Resell, redistribute, or provide access to QuestionCraft without an Enterprise agreement
- Use individual/team tier subscriptions to serve 50+ end users (requires Enterprise tier)
- Build competing products or services using QuestionCraft's technology or methods
- Scrape, harvest, or systematically extract data at scale for commercial purposes
- Use the Service as backend infrastructure for a competing product
- Circumvent paywalls, subscription restrictions, or usage limits
- Embed QuestionCraft in a paid product without proper licensing
- Represent QuestionCraft's outputs as your own proprietary technology
2.4 API Abuse
You may NOT:
- Exceed API rate limits (100/hour for Master, 500/hour for Architect)
- Share API keys with unauthorized users or embed them in public applications
- Use API access to build services that compete with QuestionCraft
- Systematically extract AI responses through the API for unauthorized redistribution
- Use the API to circumvent subscription tier limitations
- Train AI models using outputs obtained through the API without authorization
- Automate API usage in ways that violate Fair Use Policy
- Use API keys from multiple accounts to evade rate limits
2.5 Content Violations
You may NOT submit content that:
- Violates others' intellectual property rights (copyright, trademark, patents, trade secrets)
- Contains spam, unsolicited advertising, or promotional material
- Impersonates others or misrepresents your identity or affiliation
- Contains false, misleading, or defamatory information
- Harasses, bullies, threatens, or intimidates individuals or groups
- Discriminates against protected classes based on race, religion, gender, sexual orientation, disability, or other protected characteristics
2.6 Harmful and Dangerous Content
You may NOT use QuestionCraft to generate or facilitate:
Violence and Threats:
- Content promoting, encouraging, or glorifying violence
- Explicit threats of harm against individuals, groups, or organizations
- Instructions for creating weapons, explosives, or dangerous devices
- Content that could incite violence or civil unrest
Illegal Goods and Services:
- Sale or distribution of illegal drugs, controlled substances, or drug paraphernalia
- Trafficking of weapons, ammunition, or explosives
- Human trafficking, slavery, or forced labor
- Counterfeit goods or fraudulent documents
- Unlicensed gambling or illegal financial services
Self-Harm and Dangerous Activities:
- Content promoting suicide, self-injury, or eating disorders
- Instructions for dangerous challenges or activities likely to cause physical harm
- Content glorifying or encouraging substance abuse
Hate Speech and Extremism:
- Content promoting hate, violence, or discrimination against protected groups
- Propaganda or recruitment materials for terrorist organizations
- Content denying or glorifying atrocities, genocide, or violent extremism
- Symbols, slogans, or messaging associated with hate groups
2.7 Sexual Content and Exploitation
You may NOT use QuestionCraft for:
Child Safety Violations (Zero Tolerance):
- Any content sexualizing, grooming, or exploiting minors (under 18)
- Child sexual abuse material (CSAM) in any form
- Content that facilitates child exploitation or endangerment
- Age-inappropriate sexual content targeted at minors
Adult Sexual Content:
- Generating sexually explicit content (pornography, erotica)
- Sex trafficking or prostitution-related content
- Non-consensual sexual content (revenge porn, deepfakes)
- Content violating third-party AI providers' sexual content policies
Note: QuestionCraft and underlying AI providers have strict policies against sexual content. Violations result in immediate account termination and reporting to authorities.
2.8 Privacy Violations
You may NOT:
- Collect, use, or disclose others' personal information without consent
- Engage in doxxing (publishing private information to harass or intimidate)
- Violate others' privacy rights or data protection laws
- Use the Service to conduct unauthorized surveillance
- Submit content containing others' sensitive personal data (SSNs, financial accounts, health data)
- Violate confidentiality agreements or insider trading laws
2.9 Misinformation and Manipulation
You may NOT:
- Generate or spread false information intended to deceive or manipulate
- Create deepfakes or synthetic media designed to mislead
- Interfere with elections, voting, or democratic processes
- Spread health misinformation that could cause physical harm
- Manipulate financial markets through false or misleading information
- Generate fake reviews, testimonials, or social media engagement
2.10 Platform Integrity
You may NOT:
- Manipulate or abuse the question optimization system to generate harmful content
- Use QuestionCraft to bypass other platforms' content moderation or safety systems
- Submit AI-generated content as human-created without disclosure (where required)
- Attempt to confuse, trick, or exploit the Question Engine AI
- Engage in "jailbreaking" or adversarial prompting to bypass safety measures
- Use QuestionCraft to test or improve adversarial attacks on AI systems
3. Fair Use and Resource Abuse
3.1 Fair Use Standards
"Unlimited" features are subject to Fair Use Policy:
- Designed for: Reasonable professional individual or small team use
- Not for: Fully automated bulk processing, commercial resale, or serving large user bases
- Typical usage: 50-200 AI operations per day for active professional users
- Token limits: All paid tiers capped at 5,000,000 tokens/month (~150-300 high-quality AI operations daily)
- What counts: All AI operations including question optimizations, assessments, auto-optimize, and AI comparisons
- Reset schedule: Limits reset on the 1st of each calendar month
3.2 Excessive Usage
Examples of excessive usage that violate Fair Use:
- Running automated scripts generating thousands of comparisons per day
- Using QuestionCraft as infrastructure to serve your application's users
- Creating multiple accounts to circumvent limits
- Systematic extraction of AI responses for commercial redistribution
- Bot traffic or programmatic abuse degrading service for others
3.3 Enforcement
If usage significantly exceeds Fair Use guidelines:
- First: We contact you to understand use case and suggest optimizations
- Second: We recommend upgrading to Enterprise tier if appropriate
- Third: We may temporarily throttle excessive usage
- Last resort: Account suspension or termination
We always attempt communication before enforcement action (except for obvious abuse or illegal activity).
4. Third-Party AI Provider Compliance
4.1 Underlying AI Providers
QuestionCraft uses APIs from multiple third-party AI providers:
- OpenAI (ChatGPT models)
- Anthropic (Claude models)
- Google (Gemini models)
- Perplexity, xAI, Mistral AI, DeepSeek, Meta
By using QuestionCraft, you agree to comply with these providers' usage policies.
4.2 Key Provider Restrictions
Prohibited uses common across AI providers:
- Training competing AI models
- Generating illegal or harmful content
- Violating intellectual property rights
- Exploiting or harming minors
- Large-scale scraping or systematic extraction
- Using outputs for unauthorized commercial purposes

4.3 Provider Changes
AI provider policies may change over time. You are responsible for:
- Staying informed about provider policy updates
- Ensuring your use complies with current provider policies
- Adjusting your usage if provider policies change
We will notify you of significant provider policy changes that affect your use of QuestionCraft.
5. Reporting Violations
5.1 How to Report
If you become aware of content or behavior that violates this AUP:

- Evidence (screenshots, links, account information if known)
- Date and time of incident
- Any other relevant details
5.2 What We Do
When we receive reports of violations:
- Review: We investigate all reports promptly
- Action: We take appropriate enforcement action (warning, suspension, termination)
- Confidentiality: We keep reporter identity confidential when possible
- Follow-up: We may contact you for additional information
- No retaliation: We prohibit retaliation against good-faith reporters
5.3 False Reports
Knowingly filing false or malicious reports violates this AUP and may result in:
- Account suspension or termination
- Legal liability for damages caused by false reports
6. Consequences of Violations
6.1 Enforcement Actions
Depending on the severity and frequency of violations, we may:
Minor violations or first offenses:
- Send a warning with request to cease prohibited activity
- Temporarily suspend specific features or API access
- Require acknowledgment of AUP before restoring full access
Moderate violations or repeated offenses:
- Temporary account suspension (days to weeks)
- Permanent restriction of specific features (e.g., API access)
- Mandatory upgrade to Enterprise tier for commercial use
Severe violations (illegal activity, child safety, security threats):
- Immediate account termination without refund
- Permanent ban from the Service
- Reporting to law enforcement authorities
- Legal action to recover damages
- Cooperation with legal investigations
6.2 No Refunds for Violations
Accounts terminated for AUP violations are not eligible for refunds of subscription fees.
6.3 Right to Investigate
We reserve the right to:
- Investigate suspected violations of this AUP
- Access user content and activity logs as needed for investigations
- Suspend accounts pending investigation
- Cooperate with law enforcement and legal authorities
- Preserve evidence of violations
6.4 Appeals
If you believe your account was suspended or terminated in error:

- Include: Account email, explanation, and any supporting evidence
- We will review appeals within 10 business days
7. Mandatory Reporting
7.1 Child Safety
We have zero tolerance for content exploiting or endangering children.
If we detect child sexual abuse material (CSAM) or child exploitation:
- We immediately terminate the account
- We report to the National Center for Missing & Exploited Children (NCMEC)
- We cooperate fully with law enforcement investigations
- We preserve evidence as required by law
7.2 Imminent Threats
If we receive credible information about imminent threats of:
- Violence against individuals or groups
- Terrorism or mass casualty events
- Self-harm or suicide
We will:
- Take immediate action to prevent harm
- Report to appropriate authorities (law enforcement, crisis services)
- Prioritize safety over user privacy in emergency situations
7.3 Legal Obligations
We will comply with legal obligations to report:
- Criminal activity (when required by law)
- National security threats
- Court orders and subpoenas
- Regulatory requirements
8. User Responsibilities
8.1 Account Security
You are responsible for:
- Maintaining confidentiality of your password and API keys
- All activity that occurs under your account
- Notifying us immediately of unauthorized access
- Using strong, unique passwords
- Enabling multi-factor authentication (MFA) when available
8.2 Content Monitoring
You are responsible for:
- Ensuring your submissions comply with this AUP
- Monitoring outputs for compliance with third-party AI provider policies
- Not relying on AI outputs for critical decisions without verification
- Understanding that AI can generate errors, biases, or harmful content
8.3 Professional Use
If using QuestionCraft professionally, you are responsible for:
- Complying with professional codes of conduct
- Obtaining necessary permissions and consents
- Protecting confidential or proprietary information
- Ensuring use complies with your organization's policies
9. Modifications to This Policy
9.1 Right to Modify
We reserve the right to modify this AUP at any time to:
- Address new types of abuse or security threats
- Comply with legal or regulatory changes
- Reflect changes to third-party AI provider policies
- Improve clarity or address user feedback
9.2 Notice of Changes
- Material changes will be announced with 30 days' notice
- Notice sent to your registered email address
- Prominent notice posted on QuestionCraft website
- Updated "Last Updated" date at top of this policy
9.3 Continued Use
Continued use of QuestionCraft after policy changes constitutes acceptance of the modified AUP.
