1. Acceptance of Terms

By accessing or using QuestionCraft ("Service," "Platform," "we," "us," or "our"), operated by QuestionCraft LLC, a Massachusetts limited liability company, you ("User," "you," or "your") agree to be bound by these Terms of Service.

By creating an account, you represent that you are at least 18 years old or have parental/guardian consent, have the legal capacity to enter into a binding agreement, and will comply with all applicable laws and regulations.

2. Description of Service

QuestionCraft is an AI-powered platform that helps users optimize questions before submitting them to AI language models. Our Service includes:

Question Engine: Interactive AI coaching to improve question quality
Multi-AI Comparison: Side-by-side responses from multiple AI models
Framework Library: Specialized question templates for various use cases
Analytics Dashboard: Insights into question improvement and AI performance
Community Resources: 3,000+ curated question bank and 20 community pages

QuestionCraft is a gateway tool that enhances your use of third-party AI services (OpenAI, Anthropic, Google, etc.). We do not own or operate these underlying AI models.

3. Account Registration and Security

Account Creation

You must provide accurate, complete, and current information during registration
You are responsible for maintaining the confidentiality of your account credentials
You agree to notify us immediately of any unauthorized access or security breach
One account per user (no sharing accounts across multiple individuals)

4. Subscription Plans and Billing

Subscription Tiers

Crafter (Free): Limited features for trial users

Master ($19/month): Enhanced features for regular users

Architect ($42/month): Premium features with highest limits

Enterprise (Custom): Tailored solutions for teams and organizations

Billing Terms:

Subscription fees are charged in advance on a monthly or annual basis
All fees are in U.S. Dollars and are non-refundable except as specified below
Subscriptions automatically renew unless you cancel before renewal

Refund Policy:

Monthly subscriptions: No refunds for partial months after trial period
Annual subscriptions: Refund available within 30 days of purchase, prorated based on usage

5. Fair Use Policy

Understanding "Unlimited" Features and Token Limits

5.1 What "Unlimited" Actually Means

Features labeled as "Unlimited" are subject to fair use guidelines designed for reasonable professional individual use:

Token Limits by Tier:

Master Tier: Fair use for personal/small team workflows
Architect Tier: 5,000,000 tokens per month per account
This equals approximately 150-300 high-quality AI comparisons daily for typical professional use

Typical Usage Patterns: 50-200 comparisons per day for active professional users

5.2 Fair Use Definition

Fair use means:

Human-driven workflows: Not fully automated bot behavior or scripts designed to circumvent limits
Individual use: Personal or small team usage, not serving hundreds of end users through your application
Professional purposes: Research, business tasks, learning, productivity - not commercial reselling

5.3 Prohibited Usage Patterns

The following are NOT fair use and may result in account suspension:

Running automated scripts to generate thousands of comparisons per day
Using QuestionCraft as infrastructure to serve your customers (requires Enterprise tier)
Creating multiple accounts to circumvent usage limits
Systematic extraction of AI responses for resale or redistribution
Bot traffic, spam, or abuse that degrades service for other users

5.4 Enforcement

If usage significantly exceeds fair use guidelines, we may:

Contact you to understand your use case and suggest optimizations
Recommend upgrading to Enterprise tier for high-volume usage
Temporarily throttle excessive usage to ensure service quality
Suspend or terminate accounts engaged in abuse

We will always attempt to communicate before taking action except in cases of obvious abuse, fraud, or illegal activity.

6. API Access and Usage

API access is available to Master, Architect, and Enterprise tier subscribers. You must maintain an active paid subscription to use the API.

API Rate Limits:

Master Tier: 100 API calls per hour
Architect Tier: 500 API calls per hour
Enterprise Tier: Custom limits negotiated separately

7. AI-Generated Content and Third-Party Services

QuestionCraft uses APIs from multiple third-party AI providers including OpenAI, Anthropic, Google, Perplexity, xAI, Meta, and others.

Important:

You own the outputs generated from questions YOU submit. However, AI-generated content may contain errors, inaccuracies, or biases. We do not verify or guarantee the accuracy of AI responses.

8. Intellectual Property Rights

We own all rights to the QuestionCraft platform, software, algorithms, and branding. You retain ownership of your questions and inputs, but grant us a limited license to use your content to provide the Service.

9. User Conduct and Prohibited Activities

You agree to use QuestionCraft only for lawful purposes. Prohibited activities include:

Attempting unauthorized access or security testing without permission
Using stolen or fraudulent payment methods
Reselling or redistributing access without Enterprise agreement
Generating spam, harassment, or harmful content
Using the Service to harm minors in any way (zero tolerance policy)
Violating third-party AI providers' acceptable use policies

10. Data Privacy and Security

We collect and process data as described in our Privacy Policy. We implement reasonable security measures to protect your data, including encryption of data in transit and at rest.

What We DON'T Do:

Sell your personal data to third parties
Use your questions to train AI models without explicit opt-in
Share your individual data publicly or with competitors

11. Limitation of Liability

Service Provided "AS IS"

QuestionCraft is provided "as is" without warranties. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim. We are not liable for AI output accuracy, service interruptions, or consequential damages.
